Statement in Support of House Bill 401
DHAA urges members of the House Economic Development/Banking/Insurance & Commerce Committee to vote yes on House Bill 401 and protect Delaware hemp retailers, consumers, and small businesses.
Delaware’s hemp retailers are facing the threat of immediate closure despite years of serving consumers, employing Delaware residents, and operating as part of the state’s small business community. House Bill 401 provides a practical regulatory framework that allows these businesses to continue existing while also creating meaningful oversight and potential revenue for the state.
These small businesses have not asked to operate without rules. In fact, Delaware hemp retailers have been asking to be regulated. House Bill 401 responds to that need by establishing clearer expectations for the marketplace, including age-gating requirements, security access point devices, and high-level testing standards.
DHAA believes regulation is the better path forward than forced closure. Thousands of Delaware consumers have visited hemp retailers for years to access lawful hemp wellness products. Eliminating these businesses would harm consumers, business owners, employees, and local communities across the state.
With more than 250 businesses, hundreds of owners, and thousands of employees potentially at risk, Delaware lawmakers have an opportunity to stand with small businesses while also protecting consumers through thoughtful regulation.
DHAA urges members of the committee to vote YES on House Bill 401. Delaware should regulate and protect responsible hemp businesses, not eradicate them.

Why Now
Stats list:
- 13 states have outlawed delta-8 THC specifically. MPP
- 32 states have enacted some form of regulation around intoxicating hemp products. KCUR
- Delaware’s rules conform to 0.3% delta-9 THC post-decarboxylation on a dry weight basis.
- Delaware DOJ is already enforcing monopoly-style rules, treating THCa as marijuana regardless of federal protections.
